Welcome to Audio Cues. These Terms of Service ("Terms") govern your use of the Audio Cues mobile application ("App"), which is owned and operated by Radial Theater LLC ("we," "us," or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
1. License and Permitted Use
Limited License: We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on mobile devices that you own or control.
Free Tier Limits: The free version of the App permits a limited number of active shows and cues per device without payment or registration.
Prohibited Conduct: You agree not to decompile, reverse engineer, disassemble, attempt to derive the source code of, or modify any portion of the App.
2. In-App Purchases and Licenses
One-Time Purchase: The App offers an optional Unlimited Shows and Cues in-app purchase (“Unlimited”) to unlock unlimited shows and cues. This is a lifetime license available through a one-time purchase, with all currently included features. It is not a subscription.
Account Tethering: In-app purchases are tied directly to your Google Play account, not to a specific physical device. The unlocked features will automatically activate on any compatible Android device where you are logged into the same Google Play account.
Refunds: When the Unlimited package is acquired through Google Play, all financial transactions, purchases, and refund requests are handled exclusively through Google Play, subject to the Google Play Terms of Service.
3. Intellectual Property
Ownership: Radial Theater LLC retains all right, title, and interest in and to the App, including all copyrights, trademarks, source code, and user interface designs.
User Content: You retain ownership of any audio files, show designs, and metadata you import or create within the App. The App processes this data locally on your device.
4. Disclaimer of Warranties
"As-Is" Provision: The App is provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied.
Performance: While we endeavor to maintain app stability, Radial Theater LLC does not warrant that the App will be uninterrupted, error-free, or free of data loss during live performances. You are solely responsible for testing and backing up your show layouts and audio configurations.
5. Limitation of Liability
Damages Cap: To the maximum extent permitted by law, Radial Theater LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, but is not limited to, loss of profits, data loss, performance interruptions, or equipment failure arising out of or or in connection with your use of the App.
6. Governing Law
Jurisdiction: These Terms and your use of the App shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law principles.
7. Changes to These Terms
Modifications: We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last Updated" date at the top of this document. Continued use of the App after changes are posted constitutes acceptance of the new Terms.
